I recently divorced my wife under muslim law in bangladesh. Just now it passed 90 days. I have 2 kids, son age 12 and daughter 17, and we are permanent residence of UK. My kids are staying in bangladesh now since last June and I would like to bring my kids to the UK and like to take kids custody as they are away from school and I want keep their education in the Uk as my kids never studies in bangladesh.
My questions:
(1). How can I get children custody so that I can bring them in UK.
(2). If the children say that they like to stay with me, in UK, should the court order children custody remail with their mum or not.
Thanks
Mukul

Dear Mukul
Sorry for late reply. Here are your answers:
Father is the legal guardian of the children but mother can take legal custody. To take custody of your children you have to file a suit before the Family Court.
You can get the custody of your son as your son is already 13 years of old. And in case of your daughter if she denies to stay with you and if the court thinks you are not able to take custody of your daughter then you can't take her custody.
The Court always think of welfare of the child. The Court also considers children wishes.
Thaks.
